Terms of Service
Jay Kiriona Video
By booking, paying an invoice, or proceeding with services, you agree to these terms.
1. Scope of Work
Jay Kiriona provides video production services including filming, editing, and delivery of video content as agreed with the Client.
Specific details relating to the project scope, deliverables, timeline, and pricing will be confirmed prior to commencement and outlined in the invoice or written project confirmation.
This agreement applies to all video projects excluding Quick Social, which is governed by separate terms.
2. Booking & Commencement
Work will not commence until the required booking fee has been paid, unless otherwise agreed in writing.
Project dates are considered tentatively held until payment is received. Jay Kiriona reserves the right to release unconfirmed dates.
3. Payment Terms
Projects up to $3,000 NZD:
- 50% booking fee required to commence work
- 50% due prior to final delivery
Projects over $3,000 NZD:
- 40% booking fee required to commence work
- 30% due prior to review delivery
- 30% due prior to final delivery
Invoices are due within 7 days unless otherwise stated.
All prices are in NZD. GST is charged where applicable.
Overdue invoices may incur interest at a rate of 15% per annum, calculated daily.
Final deliverables are released only once all outstanding invoices are paid in full.
4. Monthly Payment Cycles (Business Clients)
Where the Client operates on a fixed monthly payment cycle (for example, payment on the 20th of the month), alternative payment terms may be agreed in writing prior to project commencement.
Where such terms are agreed, they will be clearly stated on the invoice and will take precedence over standard payment timelines.
A booking fee is still required to commence work.
5. Revisions
Each project includes two (2) rounds of revisions, unless otherwise stated.
Revisions are limited to adjustments within the agreed scope of work and do not include changes to concept, direction, or additional filming.
Any additional revisions or changes outside scope may be declined or billed separately at the standard rate.
6. Creative Control & Style
Clients acknowledge that they are engaging Jay Kiriona for his creative approach, editorial judgment, and stylistic execution.
Reasonable feedback is welcomed within the revision allowance; however, Jay Kiriona retains final creative discretion to ensure the integrity of the work.
7. Delivery
Delivery timelines will be agreed prior to commencement and may vary depending on project scope and feedback turnaround.
Review files may be watermarked or low-resolution where appropriate.
Final high-resolution deliverables are released once final payment has been received.
8. Cancellations & Project Pauses
If a project is cancelled after work has commenced, the booking fee is non-refundable.
Where additional payments have been made, refunds (if any) will be assessed based on work completed to date.
If a project is paused or delayed by the Client for more than 30 days, Jay Kiriona reserves the right to invoice for work completed and reschedule remaining work subject to availability.
9. Usage Rights
Upon full payment, the Client is granted a non-exclusive licence to use the delivered video content for its intended purpose.
Jay Kiriona retains the right to display the work for portfolio, website, social media, and promotional use unless otherwise agreed in writing.
10. Limitation of Liability
Jay Kiriona is not liable for:
- Third-party disruptions
- Platform or distribution issues
- Loss of business, revenue, or opportunity arising from use of the content
Liability is limited to the total value of the project as invoiced.
11. Acceptance
By approving a project, paying an invoice, or signing electronically, the Client agrees to these Terms of Service.
